lisa stark is in washington d.c. with more. >> reporter: john, do same sex couples have a constitutional right to marry? that is the key civil rights question the u.s. sprorlt will now decide. they will decide it in the case -- u.s. supreme court will decide. they will decide it in four cases, michigan, ohio, kentucky and tennessee all ban same sex marriage. earlier this session the supreme court punted on that question. really their hand was forced because in november the sixth circuit ruled that there is no constitutional right to same sex marriage. and that conflicted with rulings by other appellate courts. so it is up to the supreme court to decide. now, the court has touched on this issue in the past. it did decide a case but on procedural grounds that allowed same sex marriages to proceed in california. they didn't really decide that one on the merits of the case though. and they also threw out part of the federal defense of marriage act. they said the federal government does need to recognize same sex marriage

as sequestration and said it would help the middle class and boost spending on defense and we are in washington d.c. for us and lisa what else do we know about the proposed budget? >> reporter: tony the white house and president calling the budget middle class economics. as you mentioned a key part of this in something they announced today is that the budget would try to end those across the board budget cuts that went this effect in 2013 so the president is proposing an increase in spending over the current budget limits of 7 p%, $74 billion increase half go to defense, half to domestic programs. now in a piece the president wrote if congress rejects my plan and refuses to undo these arbitrary cuts it will threaten our economy and our military. so how are they going to pay for the increased spending? the white house says cutting waste and closing tax holes on the wealthy. and to help the middle class the president proposed a number of things and outlined many of them in the state of the union speech including tax credits for child care paid sick leave and free community college. speaking about

lisa stark is in a very snowy washington d.c. this morning. why did the countdown stop with just over a minute to go until launch? >> it was a disappointment for sure the problem wasn't weather in florida. it was a technical glitch. it was 1:21 before lift off when engineers said we are calling halt to this. it was a problem with a steering system for that second stage of the rocket. the stage that actually lifts the capsule into lower earth orbit into space. they knew that it would automatically shut down closer to lift off so they shut down to try to figure it out. this is the second time in two months that a technical problem has stopped the launch of this space capsule. they're going to have to hope the third time's the charm. >> walk us through this landing. space x is doing something different with this booster rocket trying to land it on a floating pad. why are they trying to do it in the ocean? >> well absolutely. here's the problem. with these lift off the rocket, basically the rocket engines are jettisoned and lost, not used again. i

kimberley is joining us live from washington, d.c. there seems to be news about two yemeni nationals who have been charged with conspiring to murder americans abroad. what do you know about that? >> reporter: that's exactly right. the u.s. justice department has just released a statement in the last hour or so saying they have announced charges against two yemeni nationals, a 36 year old, and a 30 year old. it is alleged by the justice department that these two individuals not only carried out attacks on u.s. military personnel in afghanistan, but also helped -- provided support to recruit a u.s. national to go into pakistan where that individual trained allegedly and then into afghanistan to also participate in an attack. these attacks were carried out between the period of 2003 and 2008, but they were arrested more recently in saudi arabia brought to the united states facing these charges today. if convicted they could face life in prison. >> and the united states of course conducts drone strikes in yemen as we know. they must be wa
