antonin scalia's death is impacting farm policy. the supreme court says it will not hear a case challenging the 'pollution diet' the environmental protection agency put in place for the chesapeake bay clean water blueprint. in 2010, the epa published a total maximum daily load determining how many pollutants, such as nitrogen, phosphorus and sediment may be released on a daily basis from the six states that compose the watershed. a federal appeals court ruled last year the t-md- l restrictions on runoff and wastewater pollutants are valid...and epa acted within it's authority. since the supreme court is not taking the case, that decision will stand. the national corn growers association has been saying all along, the t-m-d-l has national implications showing an 'unlawful overreach of federal regulatory power.' a win for the state of maryland is for the epa to acknowledge
