the suspect's family says thomas is apologetic and remorseful of what he did but they say he is not homophobic. the 16-year-old boy accused of setting another teenager on fire. aboard an a-c transit bus. is being charged as an adult. state lawmakers are criticizing bart for delaying the end to a controversial safety procedure. this comes after the deaths of two workers on fifth fifth the tracks last month. the procedure, known as "simple approval", made

employees working on and along the tracks responsible for their own safety and required them to clear the track in 15 seconds if a train approached. bart suspended the procedure last month when two workers were hit and killed by a train on october 19th. but that policy was also in place five years ago when a worker was killed while inspecting the tracks in concord in 2008. its going to take longer than expected to fix those broken bolts on the new eastern span of the bay bridge. work on the 23 million dollar custom steel saddles is behind schedule. workers hoped to be done early next month.

new this morning. police in antioch are investigating a deadly crash. it happened overnight in the area of 2nd street.

when officers arrived they found a vehicle had collided with a parked semi- trailer. the victim was found in the car, and pronounced dead at the scene. it is unknown at this hour if alcohol played a role in the crash. police are asking for any witnesses to come forward. >>mark:watching wall street this morning. futures trading shows all three indexes positive this morning. investors are worried the federal reserve might cut back on its economic stimulus as early as next month, after a suprisingly strong report on u-s economic growth. as a result, the stock market had it's worst day since august yesterday. here's a look at the closing numbers. the dow fell 152 points.

scratching their heads over less restrictive head lice policies that allow children with live bugs in their hair to return to the classroom. some school nurses are no longer sending home "lice notes" to parents of other children in the classroom. the policy shift is designed to help keep children from missing class, shield children with lice from embarrassment and protect their privacy. their reasoning is that lice are not dangerous or infectious, and they're easy to treat. we will be right back.

funeral plans are being made for bay area runner joy johnson. the oldest finisher who died after this year's new york city marathon. the 86-year-old from san jose died one day after finishing her 25th new york city marathon. she hit her head on the pavement during the marathon on sunday but refused to quit. johnson died of complications of blunt trauma. the physical education teacher and track coach took to running after she retired. her funeral will be held where she grew up in minnesota.

two workers who stayed behind to help the stranded residents at a castro valley care home have been honored. the "am vets" awarded the janitor and the cook of valley springs manor for not abandoning those in need. the vets said the two workers cared selfelssly for those who could not care for themselves. they also called them heroswhich is a huge honor considering the fact that most of the vets have seen combat and some have lost limbs in battle. but the two workers do not think they are heros.but just doing what was right. valley springs manor was shut down by the state on october 25th leaving 19 residents without professional care. new information on the the miami dolphins bullying case. jonathan martin's new attorney says the miami dolphins tackle endured harassment from suspended teammate richie incognito and other teammates that went far beyond the traditional locker room hazing.

temperatures are too bad. we did start off with some readings. looks like santa rosa and 40 st 46 degrees currently in san jose is relatively a mild morning. we will continue with that cloud cover into the 7:00 hour. but it's going to be pretty quick to clear and burn off. take a look at lunchtime. a lot of that cloud cover is peeling back. by later on today, temperatures expected to be a touch cooler that what we experience yesterday. with that expect the '60s and '70s and the south bay with san jose and a high of 69. temperatures as much as seven degrees cooler than what we saw yesterday. with that, walnut creek, a high of 72. downtown's san francisco hitting a high of 63 degrees and mid to upper 60s along the east bay shoreline. i do want to take a moment to talk about the weather story. we're no longer within that warming trend. you will notice we
