welcome to nevada caucus day. i'm john berman. >> i'm christine romans. it is tuesday, february 23rd. in just hours, nevada republicans will vote in caucuses across the silver state. donald trump way out front in the latest nevada polls. 26 points ahead of the rival marco rubio. this is the new cnn/orc survey. he held a raucous rally in las vegas last night. taunting protesters and taunting ted cruz calling him the biggest liar in politics. he called ted cruz a basket case and sick. jim acosta has the latest. >> reporter: john and christine, on the eve of the caucuses, donald trump with the fiery speak to date. the main focus ted cruz. following up on the resignation of the communications director rick tyler, trump branded the texas senator a liar at rally time and again. >> i'll tell you, the
evangelicals didn't vote for him you know why? they don't want to vote for a liar. they are smart people. it is true. i have an ad running right now. it is a cruz ad. a couple of people told me this. i am backing the federal government to keep the land that's currently owned by the federal government and we should give that land to everybody and divvy it up. i'm saying to myself, well, it's not a subject i know anything about. it's a hell of an ad. but this is a cruz ad. this guy is sick. there's something wrong with this guy. >> reporter: trump also sounded off on the pope who criticized the frontrunner last week for proposing a wall on the mexican border. trump wants to use the walls at the vatican as a model. he went off on a protester in the crowd saying he wanted to punch the man in the face. >> the five remaining
republicans meet head dricad-to thursday night. wolf blitzer moderates the debate only on cnn. >> that could be a big wow. hillary clinton making a big push reaching out to african-american voters ahead of the south carolina primary. she is speaking today alongside five mothers in the black lives matter movement. the clinton campaign put out a new ad with the same message narrated by morgan
freeman. >> she says their names. trayvon martin. shot to death. sandra bland. and makes their mothers fight for justice her own. she speaks for a city poisoned by indifference. >> we need action now. >> and stands with the president against those who would undo his achievements. >> bernie sanders is hitting states that vote on super
tuesday. he is in virginia
today. yesterday he was in massachusetts. where he claimed hillary clinton has been stealing his ideas and rhetoric. >> i am delighted that secretary clinton month after month seems to be adopting more and more of the positions that we have advocated. that's good. and, in fact, is beginning to use a lot of the language and phraseology that we have used. i think i saw a tv ad, i thought it was me and it turns out it was secretary clinton in the ad. >> they can take this to the voters. they come face-to-face in a town hall event here on cnn. the democratic town hall is the last time they face voters like this before they vote on saturday. tonight at 8:00 p.m. on cnn moderated by chris cuomo. >> there is so much to talk
about. let's bring in political analyst josh rogin. good morning. nice to see you. let's talk about the raucous rally last night in las vegas with trump. he was fired up. there is a moment where the protester in the crowd and donald trump really let's it all go. listen to what he said. >> here's a guy throwing punches, nasty as hell, screaming at everything else's when we're talking. the guards are gentle with him. he is walking out big high fives, i'd like to punch him in the face. >> trump supporters. >> for the punching in the face caucus. >> trump said he could shoot someone in the street in new york city and not lose a vote. he thinks he can say anything at the rallies. there is a recognition that ted cruz is stumbling.
marco rubio is attacking ted cruz. we have seen his support waiver. the trump campaign with the same calculation of the rubio campaign. him threatening to punch atte attendees in the face. as we look at the polls, in georgia and north carolina, a lot of the super tuesday states. cruz is faltering. that is what all of the other republican campaigns. >> trump calls him a liar. rubio campaign calls him a master of dirty tricks. the latest of the video tweeted out by his former communications director. he said the book has all the answers. that video is hard to understand. cruz fired rick tyler. his communications director. this is bringing more attention
to the dust up. >> cruz is going for the idea that he is the accountability guy. there will be consequences for people who stray. what he ended up doing is keeping himself off message for an extra day. that is a crucial day. the bottom line, that liar tag, right or wrong, is sticking. the cruz people know it. it is affecting their numbers. because you have trump and rubio piling on to that narrative, it is something he cannot ignore. it is a realization since jeb got out of the race, there is support around rubio. there is question about where the votes go. rubio thinks as ted cruz loses votes, it goes to rubio. ted cruz thinks as donald trump loses votes, it goes to cruz. nobody knows who is right. everybody knows they have to try to attack ted cruz. that's the guy who has the votes that are the most vulnerable. it is hard to take votes from donald trump. rubio is collecting votes as the other establishment candidates
get out. the math here that counts is ted cruz is the guy who has votes up for grabs. >> the new spike lee radio ad begins airing today. who does spike lee want to be president? >> wake up. wake up, south carolina. this is your dude, spike lee. i know you know the system is rigged. for too long, we have given up votes to corporate puppets. 99% of americans were hurt by the great recession of 2008 and many are still recovering. that's why i'm endorsing my brother bernie sanders. >> does it help bernie? >> it is probably too little, too late for sanders and the african-american vote. hillary clinton in the poll is way up. in north carolina, she has a lead that will not be surpassed. the only states where sanders is leading is massachusetts. he is competitive in michigan. he is focusing on oklahoma.
overall, we are looking at a march 1 map that favors heavily toward hillary clinton. when you add in the super delegates, with the conventional wisdom that nevada is her fire wall. she will stack up a ton of delegates. unless something changes, spike lee may not be enough. >> she won african-american votes in nevada 3 to 1. 76%. that is a huge margin. a lot of the states have higher african-american population. josh rogin, thank you. news from the senate. two republicans breaking ranks over the nominee for the supreme court justice. susan collins says the president's nominee should have a hearing. and the republicans in the senate now point to a 1992 speech by then senator joe biden
that urged then president bush not to submit a nominee during an election year. >> president bush should consider following the practice of majority of his predecessors and not -- and not name a nominee until after the november election is completed. >> that's getting a lot of attention today. >> that was june of 1992. it is february. the language he used is crystal clear. nine minutes past the hour. uber driver accused in a shooting rampage while he was working. police calling the case baffling and questions about the safety and background checks of the workers. we will tell you what uber says about it next.

killer. >> i was asking him to stop the car to let me out. he was calm the whole time. he said don't you want a ride to your friend's house. i said please pull over and let me out. he refused to stop at that point and just kept driving erratically. >> that passenger finally jumped out of the vehicle driven by the 45-year-old suspect. that shooter is held without bail accused of killing six in a weekend killing spree in kalamazoo, michigan. all the while picking up uber passengers in between the killings. according to prosecutors, he confessed to two murders and acknowledged being present at the scene where five others were shot. a 14-year-old girl is clinging to life. her family spoke to reporters. >> she is alive and she is fighting for her life. i want everybody to understand that. abigail is strong and she is a
vibrant and beautiful young lady and did not deserve this. >> investigators still have no clear motive for the rampage. let's get the latest from nick valencia. >> reporter: john and christine, the kalamazoo shooting suspect made his first court appearance since being charged with murder. he was charged with 16 counts in all. including attempted murder of a minor. that is the only time he showed any expression. he appeared video conference wearing an orange jump suit and glasses. he said only about ten words when asked if he wanted to make a statement to the court. he said he preferred to remain silent. in a probably cause hearing, detectives said after being read his miranda rights, he admitted quote to taking people's lives. his neighbors said he liked guns and cars, but mostly kept to
himself. what investigators don't know is motive. the details may come out in the next court appearance. thank you, nick. uber facing pressure this morning on the background check process. uber executives in charge of safety say the suspected kalamazoo shooter passed a background check. because he had no prior criminal record there were no issues with this guy as an uber driver. uber says the driver had a 4.7 rating out of 5 from passengers. experts say high level background checks have flaws and interviews and cross referencing applications can raise red flags, but no system is perfect. uber says it points to shareable gps tracking and policy against having firearms in vehicles. at the start of last year, uber had 160,000 drivers in the u.s. adding 40,000 new drivers each
month. protesters expected today at apple stores supporting apple's fight against the federal court order. that order requiring the company to help the fbi unlock an encrypted iphone used by san bernardino shooter far rockaway far rockaw syed rizwan farook. mark zuckerberg voiced his support for apple. >> if we have opportunities to work with governments and others to prevent terrorists attack, we have a responsibility to help make sure that society is safe. so, we care about that. that's a big deal. we take that seriously. i don't think requiring back doors use encryption is an effective way to increase security or is the right thing to do for the direction of the

here on cnn. so much to discuss this morning. we have cnn political analyst josh rogin with us. nice to see you. let's talk about this raucous rally last night in las vegas. donald trump surroundings by adoring fans and potential voters. >> whom he wants to punch. >> someone protesting in the crowd. this is what donald trump wanted to do to him. >> here's a guy throwing punches. nasty as hell. screaming and everything else while we're talking and he's walking out. the guards are gentle with him. smiling and laughing. i'd like to punch him in the face. >> add it to the list of things trump says that fans adore and only help him in the polls. >> this is another example of trump playing by his own set of rules. he wasn't threatening to punch people at rallies, he was going
after marco rubio for a story that wasn't true. the same time the social media story of marco rubio wasn't true questioning his birth right citizenship. donald trump can easily say don't do that. those rules don't apply. that is the theme of his campaign. >> it is working. we showed the nevada polling from last week. he is ahead of marco rubio in the latest polls in nevada. most importantly, he is ahead in delegates. if you look at the delegate board. trump has 68 delegates pledged. you know what? if he wins in nevada, he will build on that lead. march 1st states look favorable to trump. south carolina had proportional delegate allocation and he won all of them. if you look at the map on super tuesday, trump could end up with a ton of delegates. >> they understand that donald trump could win the majority if
not all of the states of super tuesday. a 20% threshold. you have to get to 20% to win delegates. if you don't get to 20%, you get zero. all of the rubio and cruz numbers are around 15% or 20%. that is why the rubio camp is pushing for kasich to get out of the race. that is the number they need to get over the threshold. the biggest issue is not trump, but the clock. he will run out of time to start stacking up delegates. he has to get over 20% and get kasich out of the race. he has to take votes from ted cruz. >> we will see this later this week. if these five take down trump. what could take him down? i know george will said it is time to start talking about his taxes. >> he was asked for his tax returns yesterday.
>> the campaign staff is not focused on taking down trump. they are focused on taking down each other. they think it is hard to peel off trump supporters. you are likely to stay a trump supporter. they think it is easier to get cruz and carson and kasich supporters. if there is 30% of the electorate for trump, that means there is 70% to fight for. >> and on the taxes, he is managing where trump said i don't like to pay a lot of taxes. i don't like what the government does with my money. >> you can see the establishment lining up against him when all of a sudden yesterday from george will to hugh hewett. an effort to derail him. let's talk about democrats. bernie sanders and hillary clinton fighting for african-american votes ahead of south carolina which is saturday. ahead of the march 1st states.
overnight, bernie sanders picked up radio ad from spike lee. listen to this. >> wake up. wake up, south carolina. this is your dude spike lee. i know that you know the system is rigged. i'm officially endorsing my brother bernie sanders. bernie takes no money from corporations, nada. when bernie gets in the white house, he will do the right thing. >> so bernie sanders has a lot of ground to make up. he lost african-american vote 3 to 1. >> sanders is fighting the clock. you see trends going up. in nevada, he closed the gap by 20 points. in south carolina, he is behind, but making ground. in michigan, he was down 35 points last week. he is down 15 points this week. can he make up that ground in time to win delegates to win the nomination? most people in the campaigns say no. they say hillary clinton
supported the southern states and it will yield her big wins on tuesday. sanders has plenty of money. he will be around for a while. he will make a show. he has an effect on secretary clinton's positions and the things she says on the stump. >> he knows it and says it and uses it in his stump. >> that will have an effect on clinton. the math does not work out well for him. >> he has a super delegate problem. people talk about the super delegate for hillary clinton for months. >> if you look at the map. democrats going forward. it is all proportional representation. if you start winning states, if you fall behind in delegates, it is very hard to make them up. >> josh rogin, thank you. i love it you get up early. >> happy to be here. let's talk about the supreme court. two republicans in the senate breaking ranks with the party over president obama's nominee when he makes one for the
